Web Build Intake

These TERMS & CONDITIONS are presented for full disclosure, and executing any of the following actions is – by following through on your choice(s) to perform such actions – confirming that you have, in fact, read and understand each statement (including our privacy policy):

i. Submitting an intake form for services.

ii. Booking a call to speak with Then X Local, its owner, or any party within or outside of its organization but within its network.

iii. Attending video conference or other forms of intake procedure.

iv. Extending agreement – either written, verbal, and/or in gesture – to enter into an agreed upon, bargained-for exchange of value. 

v. Remitting payment in any amount (up to and/or otherwise including, but certainly not limited to, one or more submissions of monetary and/or non-monetary forms of compensation for services).

Statements of Terms and Conditions I am to agree to.

I, the prospective / current / repeat client and/or referring party, have invested what I believe to be sufficient time reading and/or otherwise reviewing and understand, entirely, and to my personal caliber of satisfaction – regardless of if I have made any effort or no effort at all to seek clarification for – all of the following…

1. That the length of time required to complete the website is directly influenced by how quickly I provide the relevant information and/or resources requested, and even feedback, on the services purchased; this is inclusive of any and all stages of completion of services – ranging from and including, but not limited to, services not having been started, services begun, and up to and including the service provider’s deemed completion of services (even if I fail to provide requested information, resources, and/or feedback).
2. As pertaining to the website construction process, I merit one website creation video conference session with one of Then X Local’s team members and – pending the selected offering extended by Then X Local – up to one (1) revision session(s) once the website first draft is completed. If I require extra time outside these hours, I agree to be limited to purchasable video conference time at Then X Local’s current hourly rate – available for disclosure by direct inquiry and subject to the consumer’s initiative to request the current hourly rate at the time of seeking purchase of consulting time.
3. Content creation for my website shall be my responsibility under Then X Local’s expertise and advice. If I am unable to supply my website content, Then X Local can do so per the current corporate hourly rate.  Regardless of who may or may not be party to the website content fabrication and/or posting/publishing of said content, I fully acknowledge and agree to retain full ownership of any risks, results, outcomes, liabilities, and/or other responsibilities – either implicit or explicit, stated or unstated within these terms and conditions – and further agree to hold any and all parties hired and/or consulted for the website content fabrication and posting/publishing process entirely harmless.  I acknowledge and agree to the position that Then X Local and participating parties acted in my best interest, even with or without Then X Local or participating party(ies)’ awareness of current industry-related limitations or obligations of business owners in my field as to what they can or cannot do within marketing efforts.  I further agree that, as the consumer of services, this statement of holding Then X Local and involved entities/parties/people/contractors/experts and all others explicitly, implicitly, directly, or even indirectly, related to the fabrication and contents of my website harmless and without fault will persist, survive, and continue to be honored by me and any/all associated parties privileged and/or not privileged, benefactors and/or non-benefactors, to, for, and of said work product.
4. Web hosting, web address (domain), website security, and maintenance are necessary components to owning a website in modern day technology operations and are further required if I am to see my investment in website services available and/or otherwise accessible online.  If I am purchasing a website and/or website-related services, I explicitly consent to compensate, yield current payment information, and have my payment method charged by Then X Local and any/all related payment processing third-parties, a regular, appropriate-level Web Care maintenance services package – at an absolute minimum rate of $115 for ongoing web hosting, web address (domain), SSL, and routine updates (not including website backup storage activity), and/or an alternative agreed-upon maintenance package.  Further, I understand that additional limitations could prevent my website from being availabe and/or otherwise accessible online; if extraneous and/or otherwise unforeseen conditions and/or events arise that are not included in said ongoing services for which I am remitting payment, I agree to be open to a quote for additional services and further concur to be charged (through current payment method I am authorizing to remain stored and on-file by Then X Local and/or third-party payment processor partners) for necessary efforts to continue to maintain my investment in an online presence.  Additionally, I acknowledge that failure to have bargained-for services result in my online presence remaining online is entirely my responsibility and Then X Local (and associated parties) acted in my best interests, under good faith efforts, to provide me with the best, highest, and most appropriate efforts to keep my investment present online per their opinion of necessity.
5. If I wish to transfer my website to a different web hosting, I understand that my website will be considered the property of Then X Local and remain on Then X Local’s chosen web hosting until all outstanding fees are paid in full, including any payment plans and/or ongoing financial or professional / business arrangements that are not current, for a limit of 30 days time.  Beyond the 30 days limit, if I have not settled my financial dealings, and/or have not resolved satisfactory arrangements and compensated Then X Local for assistance with necessary components for migration purposes, I agree that the inevitable deletion of my investment and its resulting work product from my purchase(s) are acceptable to allow room for another client of Then X Local; and I acknowledge that ongoing maintenance fees are required in order to keep the website live, online, and/or otherwise accessible either online or offline, and failure to adequately compensate or communicate intentions is acceptable grounds for Then X Local to abolish and/or otherwise destroy – in part or in full – compensated for and/or uncompensated for work product that consumes storage associated with Then X Local business operations, and further agree to not be entitled to compensation, up to and/or otherwise including a refund or any damages that might be incurred as a result of failing to live up to my end of these terms and conditions, including financial and/or time-related obligations.
6. In the event that I request a full refund at any time, I understand that it is exclusively a request and am under no obligation to receive returned funds for any, all, or no services rendered, except as exclusively deemed appropriate and agreed upon by Then X Local at a later time and/or date.  I understand that I will not receive a copy of the website (nor it’s components, in part or in full) created, and/or composed, and/or arranged, by Then X Local and/or associated parties.  .
7. I understand that website training on how to edit and update content on my website is entirely my responsibility; if I seek consulting from Then X Local for such training, I agree to compensate them per the monetary value they deem appropriate to train me, my team, and anyone else I seek involvement for amending the work product purchased.  I further understand, acknowledge, and agree to one of Then X Local’s Web Care website maintenance packages being purchased, in one installment or ongoing, is not sufficient grounds to demand education for amending, editing, growing, or otherwise engaging with, the work product for which I had purchased from Then X Local.

PRIVACY POLICY – We are the sole owners of your personal information, business information, payment information, and privileged / trade / craft / individual business secrets that you voluntarily give us in all forms of communication, up to and including (though certainly not limited to) via vocal conversation, email, telephone, our website, video conference call, direct web-based chat, social media, and/or otherwise other forms of communication, whether such idea and communication exchange method be regarded by either party (or any third-party) as primitive or modern in nature.  We will use your information to respond to you regarding the reason you contacted us. We will not share, sell, or rent your information with any party outside of our organization at this time; we reserve the right to amend this arrangement at any time, with or without your permission, with or without your consent, with or without informing you, with or without involving you in the amendment of this arrangement, and you agree to be bound by, and hold harmless, Then X Local, its affiliated people, and any third party receiving your information, the amendments to this privacy policy, agreeing to be understood to be in explicit, implicit, complicite, or otherwise active or passive, tacet agreement to any and all changes, now or in future, to Then X Local (or changes to the brand’s name, or third parties that may partner with, merge with, and/or purchase Then X Local) and the use of information or engagement of the use of information you’ve provided either voluntarily or involuntarily.  You agree that you have no standing nor grounds for claim for any inconveniences, problems, damages, or challenges that may legitimately or illegitimately (meaning you may feel / think / perceive have / has / had arisen or is going to) arise from being involved in communication and/or patronage of services / goods with Then X Local and it’s affiliated parties or services.  If, at any point, I did not agree to any of this privacy policy or other terms and/or conditions associated with entering into business with Then X Local, I agree that by entering into business with Then X Local and it’s associated parties that I have reviewed this policy, and I have agreed to be bound by this policy and all present and/or future variations of these terms and conditions; I have had the chance to opt out of agreeing to these terms and conditions and/or privacy policy association, by simply not contacting nor purchasing from Then X Local, and that having contacted, and/or purchased from, Then X Local, I agree that my actions declare that I am in harmonious concurrence, approval, and appreciation for the statements made in the policies set forth by Then X Local and any and all third-parties to which they currently, in the past, or in the future may or continue to do business with, and that I am under no obligation to be receiving updates as to the business dealings and/or whereabouts of Then X Local or its associated partners, affiliates, contractors, or other business dealing participants.
